Selling Aerated Drinks and Bottled Water Above the MRP May Land Seller in Jail

In order to stop vendors from selling cold drinks at prices higher than MRP, Consumer Affair Minister Ram Vilas Paswan has warned of high penalty and even a jail term.


Selling Bottled Water at Prices over MRP At an event commemorating the 47th World Standards Day in Delhi, the minister said that packaged water is sold at prices at 10-20% higher than the selling price in some place and sometimes the MRP is not even mentioned.

According to the law, one can be punished with a fine of Rs 25,000 on the first offence and Rs 50,000 for the second. For subsequent offenses, a fine of Rs 1 lakh can be imposed which could also lead to a jail term.

In a current case, the apex consumer forum has imposed an exemplary cost of Rs 1.56 lakhs for charging a customer Rs 5.5 over the MRP for a cold drink.

The National Consumer Dispute Redressal Commission imposed the cost reiterating earlier judicial rulings barring hotels and eateries from charging above the MRP. The hotel opposed the plea made by the complainant contending that it took the additional amount as service charges for various facilities.

The Consumer Affairs Minister Ram Vilas Paswan said that water bottles are mostly sold at higher rates in airports and multiplexes despite court orders. He urged consumers to be more alert and file complaints in such situation.

“Consumers need to be more aware and file complaints. If there is not complaint, how can we take action?” the minister observed.

Earlier in February, the apex consumer commission had also imposed a fine of Rs 5 lakh on a multiplex in Jaipur for selling packaged drinking water at more than maximum retail price and dismissed its plea challenging a state commission order penalizing it.

Consumer affairs ministry officials said now with more options available to lodge complaints through online mediums, people should register their grievances.

“We have been pursuing people to demand receipt of whatever they buy so that it can be a proof to file a complaint” said an official.


Innovators in Delhi Create Water ATMs to Dispense RO Water at Cheaper Prices

An innovative mobile dispensing machine was developed named ‘Pilo’, which delivered 1 liter of water for Rs 5 or 250 ml of water for Rs 2. It was installed nearly a month ago outside the Botanic Garden Metro Station, making a splash. Launched by 4 members of IITians which included Jatin Ahlawat, Parveen Singh, Ajay Yadav, and Mohamad Yunus Ansari who are engineers, automation experts, water technology experts and social workers.

When they saw the plight of most Delhiites they decided that they would build drinking water ATMs – water vending machines that is purified using Reverse Osmosis Technology at a cost that everyone can afford.

The project has the backing of Noida Authority, which has also given an in-principal approval for its expansion already. According to Noida Authority officials, there are plans to install more such machine ATMs early next year.

“We expect to scale up the project in the coming months in terms of number of machines and locations. Through this technology, the public can now get clean drinking water by swiping their smart cards in the machines.”

As a member of the team, Vivek Malik explains, “RO purified water is the safest and purest form of drinking water. But the major roadblock is the wastage. The usual rate of wastage in RO filters is as high as 40-50%. We decided on Zero Liquid Discharge technology, where 95% of the input water is made available for consumption. This helped us reduce the wastage cost.”

Since a large section of the population still does not have access to clean drinking water, and the aim of the project is to provide it at a reasonable cost while being environment-friendly. Ajay Yadav also added, “The machines are solar powered, the paper cups and residual water after Reverse Osmosis are recyclable. The plan is to make the dispenser self-sustaining. The revenue earned will be used to meet the running expenses of the RO plant, salary of the operator, electricity and maintenance.”

Pi-lo has a real time water quality display, something that no one in the country has, it displays the purity of the water, the TDS count, temperature and ph level of water and display these for the users in real time. According to Vikas, if the purity of the water falls below the standards, the machine shuts down and will not dispense water. And the fact that the company in obsessed with quality.

The Noida and Delhi Authority has installed the vending machines are located at 80 locations, including 28 metro stations in Delhi-NCR. These coin-based self-service kiosks dispense close to 10,000 liters of pure water every day.

‘Unschooled’ Mumbai teenager Malvika Makes it to MIT On Basis of Her Olympiad Medals

Mumbai teenager Malvika Joshi doesn’t have a class X or class XII certificate, but she has made to the prestigious Massachusetts Institute of Technology (MIT), thanks to her computer programming talent.

She was home schooled after the VII standard – that is to say that she wasn’t schooled like other students her age, and she did not give the 10th and 12th Standard board exams either.

The Mumbai teenager has been offered a scholarship by MIT as she is pursuing an education in Bachelor of Science degree after getting a seat for being a three-time medal winner at International Olympiad of Informatics. MIT has made a provision for medal winners in the Olympiad (Math, Physics or Computer) to get accepted into this institute, and it was Malvika’s medal that ensured that she can fulfill her aspirations of pursuing research work in her favorite subject – Computer Science.

When she was unschooled, 4 years back, she explored many subjects and found programming interesting. She was unable to get admission into IITs among other elite institutes because of its requirement to pass class XII exams. The only institute which she got admission was the Chennai Mathematical Institute (CMI) where she was enrolled M.Sc. level course as her knowledge was on par with B.Sc. standard.

“My husband Raj wasn’t convinced initially as it was a risky proposition. The kids won’t have a 10th or 12th standard certificate and there was bound to be fear. I quit my NGO job and designed an academic curriculum for Malvika. I created a simulation (classroom like situation) at home. The confidence I had as a mother was that I am capable of imparting knowledge in my daughter’s.” but it worked. “Suddenly I saw that my daughter was so happy. She was learning more than ever- from the time she woke up to the time she was off to sleep. Knowledge became a passion.”

She also went on to represent India three times in the Programming Olympiad. Madhavan who prepared Malvika for all three Olympiads, elicited on her brilliance. “During the past three years she spent extensive periods at CMI acquiring the background in mathematics and algorithms that she needed to excel at Informatics Olympiad. As part of this training for IOI, she had to fill in unexpected gaps in her education arising from the fact that she had not been formally enrolled in school.”

Court Says Blaming Husband to Get Seperated From His Parents, Amounts To Cruelty: SC

The Supreme Court of India in Narendra vs K. Meena has held that persistent effort of the wife to constrain the husband to separate from the husband constitutes an act of ‘cruelty’ to grant divorce.

The Bench comprising of Anil R. Dave and Justice L. Nageswara Rao also held that leveling of absolutely false allegations with regard to extra-marital life and repeated threats to commit suicide would also amount to ‘mental cruelty’. The Supreme Court set aside a High Court judgement which had reversed the Trial court order granting divorce to the husband on ground of cruelty.

Observing that this would considered an act of cruelty, the Court observed: “No husband would ever be comfortable with or tolerate such an act by his wife and it the wife succeeds in committing suicide, then one can imagine how a poor husband would get entangled into the clutches of law, which would virtually ruin his sanity, peace of mind, career and probably his entire life. The mere idea with regard to facing legal consequences would put a husband under tremendous stress.”
Forcing Seperation From Parents
With regard to allegations of cruelty in wife forcing husband to get separated from his parents, the Bench observed: “In normal circumstances, a wife is expected to be with the family of the husband after the marriage. She becomes integral to and forms part of the family of the husband and normally without any justifiable strong reason; she would never insist that her husband should get separated from the family and live only with her… . If a wife makes an attempt to deviate from the normal practice and normal custom of the society, she must have some justifiable reason for that and in this case, we do not find any justifiable reason, except monetary consideration of the Respondent wife. In our opinion, normally, no husband would tolerate this and no son would like to be separated from his old parents and other family members, who are also dependent upon his income.”
Allegations of Extra marital Affairs
The Court observed that to suffer an allegation pertaining to one’s character of having an extra marital affair is quite torturous for any person.
Restoring the judgment of Trial Court, the Bench said: “The behavior of the wife appears to be terrifying and horrible. One would find it difficult to live with such a person with tranquility and peace of mind. Such torture would adversely affect the life of the husband.”

The report said that such ragging affects the psychology of the student and should be dealt with strictly.

The Delhi Sikh Gurudwara Management Committee had appointed Justice Bedi for this reason. They wanted to counter racial discrimination against Sikhs, was to frame guidelines for Sikh community to counter discrimination they face everywhere.

The Sikh community for years has felt the negative stereotypes have negated the positive traits of the community and demoralized them.
